Just the other day I was pulled over in traffic and issued a citation for speeding. The officer said he clocked me on radar at 50 in a 40 mph zone. After some fast talking on my part, he decided to give me a break and reduce it to 45 in a 50. During our conversation he went to explain to me that 10 miles and above and the state starts to take pts from your license or something like that. He asked me if I wanted to see the radar gun and I said certainly!
I didn't understand the whole thing at all and I don't feel he was giving me a break. I said I thought it was sort of strange that I was clocked at 50, why not 49,8,7,or 6, why 50? If you're giving me a break why don't you drop the ticket and cut the bullshyt? I know from past experience that atty's have challenged the accuracy of radar inside 10 miles over the limit and won. He just smiled and tried to direct his comments to my wife, who knew I had him hooked and never said a word!
He told me that if I showed up in court next month, the judge would probably dismiss the ticket. I asked him why and he said "because they do it all the time." I then asked him if he was going to be there and he said "Oh yes!" So I said "and you're going to say you might've made a mistake with your radar equipment when I plead not guilty huh?" He just smiled one of those UNCLE TOMMY type smiles and said you just show up!
Now my question is, do you see where I'm getting a break in here? I've got to go to court. I've got to appear before a judge. When I ask him in court, "If the radar says 50 and you wrote the ticket for 45, doesn't that say that something is wrong." I'm sure the judge won't appreciate me making that observation in open court, but I don't see no break here. At least not for me.
Now Kharma, cc5k, here is your compromise situation. This is a case of a cop not doing his job. Not doing what he's paid to do! This is what I was talking about in that earlier debate that we were having about compromising, settling, cutting deals and not doing your job! Has this ever happened to "ANY" of you? Do you call this a break? What do you think of this?

Really? LOL I think the courts are most likely to side with the cops. He has his radar gun to back him up and you have...well your word. That's why he was smiling. LOL

Here, 1 mile over the speed limit is speeding and it's $100 ticket. If I was in your situation I may have just said "give me the ticket and fucc going to court". I've only been given 1 break on a speeding ticket. Was by a brotha in Blue Ash. He said if you stay within 10 miles of the speed limit you're alright.

I concur...no tolerance here in arkansas. At least that's the law, and as usual they legislate it as they see fit. I haven't had a speeding ticket since 95 and it was my first and last so far. I went to court with proof that my car was having problems, the reciept that it was fixed and still had to pay the ticket. (rat bastids)

Exactly BISHMAN! Thats why the 50 he showed me was ridiculous, why write me a ticket for 45 and then say hes giving me a break. Thats where I was supposed to say "Thank you Officer Friendly, I certainly appreciate it," I suppose.
S G, you're right about that smile, "They do it all the time." I already know whats going to happen, but its the principle of the thing here. "If he had me at 50, why did he write the ticket at 45," is going to be my question. If 45 is within the 10 miles allowed for error, why write the ticket at all! I don't know if I'll pull it off or not, but I'm certainly not just going to pay it w'out a fight. I don't compromise! I aint never gon say "thats alright, I understand," to nothing when I don't!

I didn't think I was speeding at all, but I looked him in the eye when I passed by his spot! That bothers cops for those who don't know.
