Default Reversal Of Fortune

Submitted for your consideration:

The Bronx New York. A young man is running from a crime scene carrying a tech 9 autopistol. A pursuing officer orders him to stop. When the young man stops, he turns and fires at the officer. The officer returns fire, striking the young man and paralyzing him for life. The young man, Darrell Barnes, sues the city and the officer, for his injuries for $76,000,000 and wins. Later the award is reduced to $7,000,000. In a seperate, but related law suit, Mr Barnes now 42, sues for $51,000,000 and wins. Later the award is reduced to $10,000,000. The juries that made these awards wERE never allowed to hear testimony about the circumstances that led to Mr Barnes' injuries. They were ruling on the conduct of the officer that shot him.

At the trial 20 yrs ago, the officer said he shot Barnes twice in the chest from 35 ft away. He said he was chasing him and when he ordered him to stop, he turned and fired at him and when he returned fire, he struck Barnes twice in the chest. "The MAGIC BULLET Theory." The New York medical examiner stated that the bullet that paralyzed Barnes was fired from less than one inch away and fired straight into the back of the victim. He said he found evidence of only one bullet being fired. This was testimony in direct conflict with that of the officer and the officer's police report. This is what probably influenced the jury more than anything else.

Now, on appeal, rather than enjoying the 17,000,000 he was awarded, Barnes owes the city of New York $100, from some type of connected legislation. Barnes later admitted he did have the tech 9 and he did fire it twice at the officer who was pursuing him. Of course that admission was never heard by the jury either. The appeals lawyers say Bronx juries are notorious for their rulings and awards against the police.
